5.4 Challenging a Child Protection Plan

You cannot appeal against a Child Protection Plan (CPP) but you can challenge it by going for a judicial review. You would have to show that the decision was made on the basis or irrelevant information, or without taking into account relevant information, or that the decision was “so unreasonable that no reasonable person could have made it”, and that the outcome would have been different if the decision had been properly made, had taken into account the right information and had followed the correct procedure.
